1. What we mean by “illegal content”
Illegal content is any content on our platform — a campsite listing, a photo, a message, a profile field, anything a user can post — that breaks European Union law, German law, or the law of any other country where our users are based. This policy is written to meet our obligations under Article 14 of the EU Digital Services Act.
Concrete examples of illegal content include, but are not limited to:
- Content that sexualises minors or endangers child safety (Strafgesetzbuch § 184b, and the EU Regulation on Combating Child Sexual Abuse)
- Hate speech, incitement, or content denying or trivialising the Holocaust or other crimes against humanity (§ 130 StGB)
- Content that promotes terrorism, extremist violence, or illegal organisations
- Fraudulent listings — including fake campsites, stolen photos, bait-and-switch pricing, or solicitation of off-platform payment (see our separate Fraud & Deception Policy)
- Content that infringes copyright, trademark, or other intellectual property rights
- Content that reveals another person’s private data without their consent (GDPR violations, doxxing, unauthorised photos of identifiable individuals)
- Listings of accommodations that do not comply with local licensing, safety, or building regulations
- Threats, harassment, or targeted abuse directed at a specific person
- Content promoting illegal drugs, weapons, or unregulated commerce
If content is legal but against our community standards (for example, off-topic spam, misleading amenity claims that don’t rise to fraud, or rude but not threatening messages), it is governed by our Terms of Service rather than this policy.
2. What we do when we find illegal content
Elim Camping takes illegal content seriously. Depending on severity, the clarity of the violation, and whether the user has prior violations, we take one or more of the following actions without undue delay:
- Remove or disable the content so it is no longer visible on the platform. This happens first for anything involving child safety or clear legal violations — we act first and investigate further afterwards.
- Restrict or terminate the associated account, including both camper accounts and claimed campsite owner accounts.
- Preserve evidence for cooperation with law enforcement where required by law.
- Report to competent authorities where we are legally required to do so — notably to the German Federal Criminal Police Office (BKA) for child safety matters, and to other relevant EU or national bodies when their jurisdiction applies.
- Notify the affected user of the decision and its reasoning, unless doing so would interfere with a legal investigation or put someone at risk.
For clear cases — child safety content above all — we act immediately upon detection. For borderline cases, a human reviewer on our team evaluates the report before any enforcement action is taken.
3. Your responsibilities as a user
When you use Elim Camping — as a camper, as a claimed campsite owner, or as a visitor — you agree that you will not post, send, or list anything that falls under Section 1 above. In particular, campsite owners are responsible for making sure that:
- The listing represents a real campsite that you own or are authorised to represent
- Photos are your own, or used with explicit permission of the photographer
- Descriptions of amenities, pricing, and availability are accurate
- The campsite complies with all applicable safety, building, and licensing laws in its jurisdiction
- Family-friendly claims are accurate and do not expose children to unsafe conditions (see our Child & Family Safety Policy)
4. How to report illegal content
If you see content on Elim Camping that you believe is illegal under this policy, please report it to us. We review every report and respond without undue delay.
- Report a specific listing:use the “Report this listing” button on any campsite detail page. Our review team receives the report immediately.
- Report a message, user, or other content: email trust@elimcamping.com with a description and, if possible, a URL or screenshot.
- Child safety emergencies: if a child is in immediate danger, contact local emergency services (112 in Germany and the EU) first, then notify us at trust@elimcamping.com with “URGENT CHILD SAFETY” in the subject.
Good-faith reports are always welcome. We ask that you not submit reports for content you already know is legal just to harass another user — we investigate systematic abuse of the reporting mechanism.
5. If your listing or account is affected
If we take action against content you posted or an account you control, we will tell you what happened and why, and give you a clear way to disagree with the decision. You can:
- Reply to the notification email explaining why you believe the decision was wrong. A different reviewer from the one who made the original decision will look at it.
- Contact trust@elimcamping.com to formally complain about the decision — see our Terms of Service for the full complaints-handling process.
- Seek out-of-court dispute settlement under Article 21 of the Digital Services Act. We will cooperate with certified out-of-court dispute settlement bodies.
- Exercise your right to seek judicial remedies in the competent court in Germany or your country of residence.
6. Cooperation with authorities
Elim Camping cooperates with law enforcement, regulatory bodies, and competent authorities where required by law. We respond to valid legal orders and requests for information in a timely manner, and we preserve evidence of illegal activity where we are required to do so. Requests from authorities should be directed to legal@elimcamping.com.
7. Changes to this policy
We may update this policy to reflect changes in law, changes to our platform, or lessons we learn from enforcement. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify users directly. Continued use of Elim Camping after a change means you accept the updated policy.
